Aldes Auctions is operated by Aldes Business Brokers (Pty) Ltd ("Aldes Auctions", "we", "us" or "our"), of 19 Titan Street, Rietfontein 395JR, Pretoria, 0056, South Africa. This policy explains what personal information we collect through this website, why we collect it, how we use and protect it, and the rights you have over it under the Protection of Personal Information Act 4 of 2013 (POPIA).

By using this website, submitting an enquiry, or registering to bid on an auction, you acknowledge that your personal information will be processed as described in this policy.

1. Information we collect

We collect different information depending on how you interact with the site.

General enquiries and leads

When you submit a callback request, property alert, listing enquiry, brochure request or the general contact form, we collect your name, email address, phone number, and any location, property type or message details you provide.

Bidder registration

When you register to bid on an auction, we collect the information necessary to verify your identity and administer your participation, including:

• Full name, phone number and email address
• South African ID or passport number
• Residential address
• A copy of your identity document or passport
• Proof of residential address (such as a utility bill or bank statement)
• Where you are bidding on behalf of a company, trust or other party: the entity name, registration or reference number, and any supporting authority or FICA documents you provide
• Deposit and payment records, including proof of payment, where a registration deposit applies to the auction

2. How we use your information

We process your personal information to:

• Respond to enquiries and provide information about auctions, listings and our services
• Assess and process bidder registrations, including identity and FICA verification required to approve you to bid
• Administer registration deposits, buyer's premiums and other auction-related payments
• Communicate with you about an auction you have registered for, including changes, requirements and outcomes
• Comply with our legal and regulatory obligations, including record-keeping requirements under FICA and other applicable legislation
• Maintain the security and proper functioning of this website

Where you tick a consent box on an enquiry or registration form, we rely on that consent for the related processing. Where information is needed to verify you as a bidder or to meet a legal obligation such as FICA, we process it because it is necessary for that purpose, whether or not separate consent is given.

3. Sharing your information

We do not sell your personal information. We may share it with:

• The Aldes Auctions team and relevant staff who need it to process your enquiry or registration
• The auctioneer, transfer attorney, or other professionals involved in a specific auction you are participating in, strictly as needed to complete that transaction
• Service providers who host our website, database and uploaded documents on our behalf, currently Vercel (website hosting) and Supabase (database and document storage), under obligations to keep your information secure and to use it only for the purposes we specify
• Regulators, auditors or law enforcement where we are legally required or permitted to do so

4. Cross-border storage

Our hosting and storage providers may process or store information on servers located outside South Africa. Where this occurs, we take reasonable steps to ensure those providers apply a level of protection for your information that is comparable to the safeguards required under POPIA.

5. How long we keep your information

We retain bidder registration records, identity documents and deposit records for as long as necessary to meet our FICA, tax and other legal record-keeping obligations, and thereafter for as long as needed to defend or establish a legal claim. General enquiry and lead information is kept for as long as reasonably needed to respond to your enquiry and for a reasonable period afterwards, unless you ask us to delete it sooner and we are not required to retain it.

6. Security

We apply reasonable technical and organisational measures to protect your personal information against loss, unauthorised access, alteration or disclosure, including restricting access to registration and identity data to staff who need it and using reputable, security-conscious hosting and storage providers. No system is completely secure, and we cannot guarantee absolute security of information transmitted over the internet.

7. Cookies

This website uses a single functional cookie to keep an administrator signed in to the admin area. We do not currently use analytics, advertising or tracking cookies on the public site. If this changes, we will update this policy accordingly.

8. Your rights

Under POPIA, you have the right to:

• Ask us to confirm what personal information we hold about you and to access it
• Ask us to correct or update inaccurate, incomplete or outdated information
• Ask us to delete personal information we no longer have a lawful basis to keep
• Object to the processing of your personal information on reasonable grounds, and to object to your information being used for direct marketing
• Withdraw consent you previously gave, where our processing relies on that consent, without affecting processing already carried out
• Complain to us or to the Information Regulator if you believe we have not handled your information properly

9. Children

This website and our auction services are intended for adults. We do not knowingly collect personal information from children, and bidder registration requires a valid adult identity document.

10. Third-party links

This site may link to third-party sites, such as aldes.co.za or Google Maps. We are not responsible for the privacy practices of those sites, and encourage you to review their own privacy policies.

11. Changes to this policy

We may update this policy from time to time to reflect changes in our practices or legal requirements. The date at the top of this page shows when it was last updated.
